Tech Pasar — Terms & Conditions

Operator / Seller: Tech Pasar is a brand operated by CINCH FINANCIAL PTE. LTD. (UEN 202222123W), a company incorporated in Singapore with its registered office at 160 Robinson Road, #14-04, Singapore Business Federation Centre, Singapore 068914 ("we", "us", "our").

These Terms & Conditions (the “Terms”), together with our Refund & Returns Policy and Privacy Policy, govern your use of the Site (Part A) and your purchase of products from it (Part B). By using the Site or placing an order, you agree to these Terms. If you do not agree, please do not use the Site.


Definitions

In these Terms, capitalised terms have the meaning given where they first appear. In particular:

  • “Site” — techpasar.com and its related pages.

  • “Device” / “product” — any consumer electronic device offered on the Site (e.g. smartphones, tablets, laptops, wearables, audio), together with any accessories sold with it.

  • “Grade” — the condition grade (A, B or C) we assign to a refurbished or pre-owned Device, as described in clause 8.2.

  • “Refunded Device” — a Device for which we have refunded the purchase price, as described in clause 13.

  • “Agent” — any software or service that takes autonomous or semi-autonomous action to access or interact with the Site, as described in clause 3.


Part A — Using the site

1. Eligibility and accounts

You must be at least 18 years old and able to enter a binding contract. You are responsible for the accuracy of information you provide, for the security of your account credentials, and for all activity under your account. You may not transfer, sell or assign your account.

2. Acceptable use

You may use the Site for lawful purposes only. You must not:

  • use the Site for any unlawful, fraudulent or malicious purpose, or to breach any applicable law;

  • infringe our or others’ intellectual property, privacy or other rights;

  • harass, abuse, defame or harm any person, or transmit false or misleading information;

  • send spam, junk mail or unsolicited promotional material;

  • impersonate any person or entity;

  • upload viruses or malicious code, or interfere with, probe, scrape or overload the Site or its security measures;

  • reproduce, duplicate, copy, resell or exploit any part of the Site; or

  • collect or track others’ personal data.

We may suspend, disable or terminate your access at any time if we reasonably determine you have breached these Terms.

3. Automated agents

This clause applies if you use, enable or cause the deployment of an Agent. An Agent must, at all times: identify itself as an Agent in its HTTP/HTTPS user-agent string in the form “Agent/[agent name]”; not conceal or obfuscate that interactions come from an Agent (including by mimicking human behaviour or circumventing CAPTCHAs); respond truthfully to any human-or-machine check; and not circumvent any measure we use to block, limit or control Agent access. We may limit, including by technical measures, whether and how any Agent accesses the Site.

4. Intellectual property

The Site and its content (text, graphics, logos, photographs, designs, and their selection and arrangement) are owned by us, our affiliates or licensors and protected by Singapore and international intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable licence to use the Site for your personal, non-commercial purposes only. You must not reproduce, distribute, modify, republish or commercially exploit any part without our prior written consent. “Tech Pasar” and “Cinch” names and logos are our marks; Shopify’s marks are Shopify’s; third-party manufacturer marks (e.g. Apple, Samsung) belong to their owners and are used only to identify products.

5. Feedback

If you submit ideas, suggestions, reviews or other feedback, you grant us a perpetual, worldwide, royalty-free, sublicensable licence to use, reproduce, modify, publish and display it for any purpose, including commercial use, to the extent permitted by law. We are under no obligation to keep feedback confidential, pay for it, or respond. You confirm you own or have rights to your feedback, it is not unlawful or infringing, and you have disclosed any incentive received for it.

6. Third-party tools and links

We may provide access to third-party tools “as is” and “as available”, without warranty or endorsement, and we are not liable for your use of them. The Site may link to third-party sites we do not control; you access them at your own risk and should review their terms. Direct complaints about third-party products or services to that third party.

7. Relationship with Shopify

Tech Pasar is powered by Shopify, which enables us to provide the Site. Any sales and purchases you make are made directly with Tech Pasar. Shopify is not responsible for any aspect of sales between you and Tech Pasar, including any injury, damage or loss from purchased products. You release Shopify and its affiliates from all claims arising from your purchases and transactions with Tech Pasar.


Part B — Buying from us

8. About our products

8.1 Condition of our products

Most products sold on the Site are refurbished or pre-owned electronic devices; some may be new or unused. The condition of each specific device is stated on its listing. Refurbished and pre-owned devices are professionally inspected, tested and graded before sale, and will show characteristics consistent with prior use. New or unused devices are labelled as such.

8.2 Grading

Every refurbished or pre-owned product carries a grade, shown on its listing (new or unused items are labelled “New” instead):

  • Grade A “Premium” — light or no cosmetic wear; fully functional; like-new appearance.

  • Grade B “Very Good” — visible cosmetic wear (minor scratches/scuffs); fully functional; used appearance.

  • Grade C “Fair” — significant cosmetic wear; fully functional; sold as-is, with all visible defects disclosed in the listing.

Cosmetic imperfections consistent with the stated grade are characteristics, not defects. Product images are illustrative of the model and grade, and the device you receive may differ slightly in appearance.

8.3 What each listing includes

Each listing describes the device — including its grade, condition notes covering any material flaws we are aware of, key specifications (such as storage, colour and model), and the accessories included (only as stated). Where a listing shows additional detail such as photographs or battery health, that detail is provided as a guide and is indicative only.

8.4 Battery health

Battery capacity degrades naturally with use. Reduced battery health is an ordinary characteristic of a pre-owned device and is not, on its own, a defect.

9. Pricing and payment

  • 9.1 Prices are in Singapore Dollars (SGD) and inclusive of GST at the prevailing rate (currently 9%). Where a device is sold under the Gross Margin Scheme, GST is not separately shown and is not claimable as input tax by the buyer.

  • 9.2 Price errors — if a device is listed at a manifestly incorrect price due to a typographical, system or pricing error, we may cancel the order (even if accepted) before dispatch and refund any amount paid in full. This does not affect your statutory rights.

  • 9.3 Payment — via the methods shown at checkout (currently cards and PayNow QR via Shopify Payments). Payment is due in full at order. Your order is confirmed only after payment is successfully received.

  • 9.4 Instalments / BNPL (if offered) are provided by third parties under their own terms and approval; we are not responsible for their services or decisions.

10. Orders and acceptance

A listing is an invitation for you to place an order — not a binding offer by us to sell. When you place an order, you are making an offer to buy, and a contract is formed only when we send you a dispatch confirmation email. Before dispatch we may decline or cancel an order for any reason — including stock unavailability, a pricing or description error, inability to verify your details, or suspected fraud — and we will refund any payment in full.

11. Shipping, delivery, risk and title

  • 11.1 Coverage — Singapore addresses only.

  • 11.2 Timing — standard delivery is within 3–5 business days after dispatch confirmation. Same-day delivery is not currently offered. . Delivery times are estimates, not guarantees, and we are not liable for delays outside our reasonable control.

  • 11.3 Risk passes to you on delivery to the address you provide (or collection). Title passes only when we have received full payment.

  • 11.4 Failed delivery — if delivery fails due to incorrect details, refusal, or repeated unavailability, we may charge a reasonable re-delivery fee or treat the order as cancelled.

12. Returns and refunds

  • 12.1 14-day guarantee — within 14 days of delivery you may return a device that is materially different from what was described or graded in its listing (excluding cosmetic wear consistent with the disclosed grade), or that has a functional defect existing at delivery. Contact us within the window with your order number and supporting photos or video.We cover return shipping for all eligible returns under this clause via the method we arrange. Customers are not required to pay return postage for eligible returns. 

  • 12.2 No change-of-mind returns — Singapore has no statutory cooling-off period for online retail, and we do not accept returns simply because you changed your mind, found the device cheaper elsewhere, or decided it was not for you.

  • 12.3 We cover eligible returns — for any return eligible under clause 12.1, we pay return shipping (via the method we provide) and charge no restocking fee.

  • 12.4 Our remedy — on verification, we will issue a refund to the original payment method , consistent with the statutory tiers (repair or replacement first; refund where that is impossible or disproportionate). For a device that is materially not as described, a refund or replacement is normally appropriate.

  • 12.5 Refund timing — we will initiate an approved refund within 7–14 business days of receiving and inspecting the return , to the original payment method. The time for funds to reach you then depends on your bank, card issuer, or payment/BNPL provider, which is outside our control. On refund, title re-vests in us (clause 13).

  • 12.6 Disclosed flaws and Grade C — defects disclosed in the listing (including on Grade C units) are not grounds for return. Your non-excludable statutory rights are always preserved (clause 14).

  • 12.7 Condition of returns — please return the device with all accessories and packaging supplied with it, in the condition you received it, and with all personal data, accounts and activation locks removed (e.g. Apple ID/iCloud, Google, Samsung). We will not unreasonably refuse a valid claim where original packaging is no longer available, but missing accessories or buyer-caused damage may be deducted from any refund.

13. Device ownership following a refund

Where we refund the purchase price of a device (a “Refunded Device”), title re-vests in us when you receive the refund. You must promptly return it on request, having first removed all personal data, accounts and activation locks (e.g. Apple ID/iCloud, Google, Samsung). If a Refunded Device is returned with an active lock that prevents us testing or reselling it, or is not returned, we may withhold, reduce or reverse the refund, charge a reasonable administrative fee, request that the device be blocked by its IMEI/credentials, and/or take recovery steps at your cost.

14. Warranty and statutory rights

14.1 Tech Pasar Eligibility
We provide a 30-day (calendar) limited warranty from the date of delivery, covering functional hardware defects that existed at the time of delivery and are not attributable to any excluded cause. This warranty applies to Grade A and Grade B devices only — Grade C devices are sold as-is and carry no warranty coverage.

To be eligible, the defect must be a hardware or software fault not caused by human error, and the claim must be submitted within the applicable warranty period. Where a manufacturer's official warranty policy applies, coverage will follow that policy and may be subject to brand-specific requirements.


14.2 Warranty Exclusions

The warranty does not cover cosmetic wear and tear consistent with the device's grade (including scratches, dents, or other surface marks), cracked or broken screens, water or liquid damage, or battery degradation, which is a normal characteristic of pre-owned devices. Pre-existing issues or defects disclosed in the product listing are likewise excluded, as are faults or claims notified outside the warranty period.

Physical damage caused by drops, impacts, accidents, misuse, negligence, improper handling, or other forms of human error is not covered, nor is damage resulting from unauthorised repairs, modifications, use of non-original parts, or third-party accessories. Exposure to extreme environmental conditions or causes beyond Tech Pasar’s control is also excluded.

The warranty does not extend to loss of data, software, apps, or account-related issues, or to problems arising from the installation of third-party or modified software. Compatibility issues with telco or network providers, and network limitations for devices used outside Singapore, are similarly not covered.

14.3 How to claim

Contact us at support@techpasar.com with your order number, a description of the issue, and photos or video. We will assess and, at our option, repair, replace, or refund a fair amount after verification. For valid claims we cover return-to-base and outbound shipping; for invalid claims we may charge inspection and shipping fees. Please back up your data first — we are not responsible for data loss.

14.4 Statutory rights preserved

Nothing in this warranty limits or excludes your rights under the Consumer Protection (Fair Trading) Act 2003 or the Sale of Goods Act 1979, which apply to second-hand goods. In particular:

  • Goods must be of satisfactory quality (assessed relative to their grade, age and the price paid), as described, and fit for purpose.

  • A defect shown within 6 months of delivery is presumed to have existed at delivery unless we prove otherwise.

  • Remedies follow the statutory tiers: repair or replacement first; price reduction or refund if repair or replacement is impossible or disproportionate.

These statutory rights apply in addition to the limited warranty and cannot be excluded.


Part C — General legal terms

15. Disclaimers

The Site is provided on an “as is” and “as available” basis. We do not warrant that it will be uninterrupted, timely, secure or error-free, or that information presented for general information is accurate or complete. This disclaimer applies to the website itself — not to the products you buy, whose quality is governed by clause 14 and your non-excludable statutory rights. We may correct errors, inaccuracies or omissions (in descriptions, pricing, promotions or availability) and change or cancel orders if information is inaccurate, at any time without prior notice.

16. Limitation of liability

  • We are responsible for foreseeable losses caused by our breach of these Terms.

  • To the maximum extent permitted by law, we are not liable for indirect, consequential or special losses; loss of profit, business, revenue or goodwill; loss of data; or losses from events outside our reasonable control (clause 18).

  • Our total liability for any product is limited to the amount you paid for that product.

  • Nothing in this clause limits liability that cannot lawfully be limited — including under the Consumer Protection (Fair Trading) Act 2003, for death or personal injury caused by our negligence, or for fraud. This applies to us and (for use of the Site) to Shopify and our respective affiliates.

17. Indemnity

You agree to indemnify and hold harmless Tech Pasar, Shopify and our affiliates from claims, losses, liabilities and reasonable costs (including legal fees) arising from your breach of these Terms, your violation of any law or third-party right, or your misuse of the Site.

18. Force majeure

We are not liable for delay or failure caused by events beyond our reasonable control, including natural disasters, war, civil unrest, pandemics, government action, courier or logistics disruption, or failure of utilities or telecommunications.

19. Privacy and data

We handle personal data under the Personal Data Protection Act 2012 and our Privacy Policy. By using the Site or ordering, you consent to use of your data to process your order, communicate with you, and meet legal obligations. Because the Site is hosted by Shopify, certain data may also be subject to Shopify’s privacy policy and processed by Shopify and partners, including outside Singapore, to provide the Site. Marketing is sent only with your separate, explicit opt-in.

20. Governing law and disputes

These Terms are governed by the laws of Singapore. Please contact us first at support@techpasar.com so we can try to resolve your concern. Failing that, disputes are subject to the exclusive jurisdiction of the Singapore courts. We may also offer mediation through the Singapore Mediation Centre or the Consumers Association of Singapore (CASE).

21. Changes

We may update these Terms from time to time. The updated version is posted on the Site with a new effective date and applies to use of the Site and orders placed after that date.

22. Termination

We may suspend or terminate your access to the Site at any time. Provisions that by their nature should survive — Intellectual Property, Feedback, clauses 13 to 20, and this clause — survive termination.

23. General

  • Severability / waiver: if any provision is unenforceable, the rest continues; failure to enforce a provision is not a waiver.

  • Entire agreement: these Terms and the policies they incorporate are the entire agreement between you and us.

  • Assignment: you may not assign these Terms without our consent; we may assign to a group company or successor.

  • Notices: we may give notice by posting on the Site or by emailing the address linked to your order or account; you may reach us using the details in clause 24.

  • No partnership: nothing in these Terms creates a partnership, agency or joint venture between you and us.

  • Third-party rights: except for our affiliates and Shopify (who may enforce clauses for their benefit), a person who is not a party has no right under the Contracts (Rights of Third Parties) Act 2001 to enforce these Terms.
